Though I see this is not his fault- why was this not voted on during his first term with Nancy Pelosi in charge of the house?

Obama signs order to close Guantanamo Bay facility - CNN.com

How did the executive order get signed but the base never closed?

As a side note I detest most executive orders as they are not a action that demonstrates a Democracy or Free Republic.
