Don't be so flattered. I'm not mad at all. The ones that are actually getting mad are those that feel the same way you do about brake checking.

I've dealt w/ many insurance companies and they don't do this anymore. They WILL investigate and place the blame on the other driver for their part of the accident. Even in a rear end collision if the insurance companies are going to investigate. Especially after the scams that were going around the last few years. People would intentionally pull in front of a driver (especially elderly drivers in nice vehicles) and slam on their brakes causing a rear end collision. The insurance companies would just write the checks. Not anymore.
If YOU don't believe me go out and get rear ended and see how long it takes to get a check from the insurance companies if you get one at all.

It was exactly 2 years ago that I was at a stoplight that had turned green. Because I was behind about 4 cars, I was not yet moving when I got rear-ended - HARD - by some idiot that wasn't paying attention. Hey guess what? The adjuster looked at the police report, came and looked at the car, and I had an insurance check in my hand less than 10 days later. His insurance also paid for me to go see the chiropractor to make sure everything was okay.
A year before that, one of my sons got rear-ended in almost exactly the same fashion up in the Minneapolis area. Exact same outcome. After we refused to accept the insurance company's initial offer for the value of his pickup, they came to terms VERY fast. He had an insurance check in hand between 2-3 weeks after the accident.
Say what you want, but if you rear-end somebody, the burden of proof is on YOU to PROVE that it's somehow not your fault. And unless there are some extenuating circumstance - some very rare and bizarre ones - you will never be shown completely without fault.
It's only impeding traffic in the minds of insane truck drivers who think that, because their rig weighs 80,000 lbs, they own every road and are entitled to drive however they want.
So, now you're saying that while your brake pedal was planted to the floorboard, you were still going 63???????
