There is some confusion herein about the topic of this thread. Understandable, since Mr. Trump has multiple civil and criminal proceedings against him, in both state and Federal courts.
This thread concerns the ongoing Civil Fraud proceeding in a New York State court.
There was no jury trial concerning whether Mr. Trump and his companies engaged in fraud. The reason is that during his August deposition, Mr. Trump invoked the Fifth Amendment right against self-incrimination some 450 times.
Now, in criminal matters, pleading the Fifth cannot be used against you. No negative inference may be drawn from pleading the Fifth.
But, this is a civil proceeding. If one pleads the Fifth in a Civil proceeding, then negative inferences may be drawn.
Since it appears that Mr. Trump only answered a few questions regarding his name and where he resided, but pleaded the Fifth to every other question that had any connection with his potential fraudulent business activity, then the presiding Judge was able to grant the State a summary judgment on the issue of whether or not Mr. Trump engaged in civil fraud.
As such, the ongoing trial is only concerned with the civil penalty.
For those that ask "Why wasn't Mr. Trump allowed a jury?", the answer is simple: Mr. Trump opted for a trial by judge.
Mr. Trump is in the position he finds himself solely due to his own acts: pleading the Fifth some 450 times, and opting for a judge to decide punishment rather than a jury.
Obviously, Mr. Trump decided that it was better to risk his business by pleading the Fifth, rather than commit perjury; or, in the alternative, telling the truth and then risk criminal prosecution if he admitted to the fraudulent business behavior.
Like father like son, Eric Trump (a VP) invoked the Fifth Amendment some 500 times. It is unclear if Ivanka and Don Jr. did the same.
If you desire to see the former President of the United States invoking the Fifth Amendment ("like a mobster", he once claimed, decrying those that sought Fifth Amendment protection), google it. There are plenty of videos of the almost six hour long deposition.
... Whether he is jailed or not, hard to see how Trump wins this election. He has never won an election before. He lost the first one by 3 million and the second one by 7 million...
