If any one (adult or minor)is in custody and not given the Miranda warning no statements made by them can be used later against them. However, prior to being placed in custody any statements made can be used; or if they were read their rights and made voluntary statements after, those statements may be used. Whether or not your son's rights were violated you should consult directly with a juvenile law attorney in your area as to how best to handle this situation.

I would think the kid was clearly " in custody".

You can stop a kid and question him on the street. But as soon as you get him in a situation where he is not able to leave he is in custody. This is not a Terry stop.

This is a classic move in the liberal playbook. It's called the "double down". You can observe it right here in this thread, with commentators declaring that little Ahmed had his rights violated for being questioned by police (lol).

His rights would have been violated if he were detained, arrested (which would necessitate having his Miranda rights read) and then refused access to his parents or lawyer. Of course he was not charged with any crime, but the posters here can't admit that they're wrong, so they double down on their logical fallacies.

Likewise, Obama and fools like Zuckerberg can't admit that they were wrong. So now perhaps instead of insisting that Ahmed is a master genius inventor of timepieces who was the victim of a racist culture, he's instead an ambassador for "science" (who is also a victim, somehow). They need to come up with something to save Ahmed's character, and thereby salvage some of their own reputation. Of course, anyone who has enough engineering sense to tie their own shoelaces realizes that Ahmed is a fraud and invented NOTHING. But you also need to remember... people who buy into these narratives don't exactly care about the truth, nor do they have any interest in rational thinking.

These are people who get their news from Twitter hashtags and funny pictures on Facebook timelines, and stuff like this gives them a self-righteous shot of dopamine.

That the clock is an underachievement is true. That the kid got jumped on for being Muslim also appears true. The school and the police got carried away apparently driven by the ethnicity. And that becomes more credible in a town running an idiot campaign against Sharia.
