It can in this case. The prosecutor has 30 days to decide if they want to pursue that route.

"Marion County prosecutor Terry Curry called it a 'thoroughly senseless act.' He said his office would review whether to pursue the death penalty or life in prison without parole against the three."

Three charged with murder after 'setting off deadly Indiana house explosion that killed young couple and destroyed five homes | Mail Online

I don't think Curry will have any problem convincing the jury to convict someone who blew up 30 houses and killed two people to collect insurance money. This case will sell itself.

I just read that Leonard was on Craigslist the week before the explosion looking for a Ferrari to buy with the insurance money.

I am thinking that Shirley might turn on her boyfriend and testify against him.

It appears that he has a history of swindling women. One of the reports I saw mentioned that he used to pick older or overweight women off an online dating site and then "borrow" large amounts of money from them.

One gal sued him and won the judgement of $70,000. She said now she knows where to serve him, Marion County Jail.

Shirley hired her own attorney (wonder where the money came from) and the other two are getting court appointed lawyers.

One story said Shirley knew about the other women and it was ok? so long as he did not sleep with them. All three are losers, losers, losers.
