If the child is old enough they should consult the child. It is amazing to me that it is almost NEVER about what the child wants.
I am a party line republican voter and do not have a problem with gay couples raising children. There is a lot of need and gay couples can help fill it. That being said, it should be about the child's happiness.

If you bothered to read the article posted, you'd know that the child is a 3 month old infant.
This is not surprising in Utah where a thin line separates church and state. But I think even the LDS church would disapprove of just ignoring the law by a judge.
