The state cannot take children away from a mother who tests positive for marijuana use without evidence that shows her drug use endangers the children, the Oregon Court of Appeals has ruled.

In a decision issued today, the court reversed a Marion County juvenile court ruling that the state Department of Human Services had jurisdiction over two children, a 19-month-old and a 6-month old.

the adults in political power, running this country, are the hippies of the 1960's but instead of smoking pot and dressing like hippies, they wear suits and play a role. they still stick it to the imaginary man every chance they get.

thats why our country is going to pot (pun hehe) thats why underaged strippers are allowed to perform "theater" for older men and why you have this gross leniency in government towards illegal drugs.

Reading the story, the real problem here is the dad, not the mom! He's the potentially meth-dealing sex offender. She just smoked marijuana at a party. I'd have some real questions about her decision making for being with this guy and having him around the kids, but as far as using marijuana, I agree that the government has no business taking them away from her just because they found that she used the drug once but have no evidence that she was around her kids at the time. It sounds like the kids were doing fine, and I doubt they'd be any better in the foster care system.

it is .. if somebody calls cps in on you .. the save the kids mentality is more endangerment that leaving them with the mom who smokes it at a party someplace and is seen ..
has it ever occured to any one how someones dislike/need to contril/be a"good " citizen can cost you these days .. very much like living in China where your watched alla time. sad really .. If kids in a bathtub can get your kids taken because your taking pictures of them doing a cute thing .. ( it happpens remember) by a stranger who saw the film ( walmart clerk) then what? ..
I sure would be concerned for the kids because of what the dad is but the mom .. humm.. laspe of good judgement but kids wer'nt there so no issue ..

No responsible person, and there are many responsible people who use tobacco, alcohol and marijuana regularly, would want children of any age to use any of those substances, but adults should be able to without the anti-everything crowd pushing their agenda by throwing babies in our faces. The adults in political power certainly are not hippies. If they were our country would be a lot more loving and caring of each other and we wouldn't be fighting wars on multiple fronts. If hippies were in control we'd have a sensible drug policy and more healthy food without pesticides. The corporations are in control not the people.

I've known plenty of parents through the years who were pot smokers and still great parents. I'm not sure it is a reliable measuring device. Certainly no reason to remove a child from their home into foster care.

I wonder if the kids were ever tested for exposure? This is one of the things I think about when people are so happy to legalize mj in Ca. What about the kids?

Oh and as far as that household goes, the sex and meth issues are maybe more scary than the mj!

They don't take away kids just because the parents drink, smoke, or eat tons of junk food. Why would marijuana be any different?
