I just wanted to update my situation from the last two pages in case anyone else is in a similar situation. I checked my claim profile online today and it no longer says BENEFITS EXHAUSTED. Now it says REGULAR ACTIVE CLAIM and a new category for Extended Benefits (EB) is posted right above the EUC category. So, if you're waiting on tier IV and are hurting financially like I am, looking into EB may help get you by until tier IV kicks in. I'll post an update Monday or Tuesday after I file my certification to confirm it's working properly.

this is from the official rules for Tier 3 and 4 extension:

Tier 3 benefits are added to your claim automatically the first working day after Tier 2 exhausts. You do not need to apply for Tier 3 benefits. Tier 3 will not be added to any EUC claims exhausting with payments for any weeks after April 3, 2010.
Tier 4 benefits are added to your claim automatically the first working day after Tier 3 exhausts. You do not need to apply for Tier 4 benefits. Tier 4 will not be added to any EUC claims exhausting with payments for any weeks after April 3, 2010.

if they make Tier 4 not retroactive, i will hire a lawyer and sue NCESC for damages. if i win millions, i'll share with everybody

I think that date will be changed again soon to include all of 2010.

Great thanks! for the info.

The only problem is, that if anyone waiting for tier 4 has any past disqualifications .,
example .....
If they had to get an appeal to win their benefits. ect.
They won't qualify for EB.
EB has strict guidlines.
However, I'm glad you posted that so possibly other's will get some relief from their EB until tier 4 kicks in.

We're way past the point of reason here. If a person still believes that Tier 4 payment is hung up because of "computer issues," their naivete is as boundless as the prevarications of NCESC.

Prevarication is a polite word for lie.

Ok today is Friday so I called again. The man I spoke with was very nice. He said all the pull forwards were on hold with the IT department. He said they got an email today saying they hoped to have it fixed by the middle of March. He said to him that meant next week or at least the following week. Fingers crossed and nervous now.

Tom, I think you are probably right. However, I do not think the reps themselves are purposely lying. I think they are just telling us what they are being told. Esc can't do anything with the money until NC releases it to them. Maybe everyones complaints should be going to the governors office or their state representatives. I think it is easy to jump on the person helping us when we all know they aren't the ones making the decisions. When I had a job, I did what my boss told me to do with reason of course. I didn't ask why or try to tell him how to run is company. If I did I'd have been unemployed a long time before I was.

Pretty sure I read yesterday that the bill extending the date to 12/10 passed both the house and senate. I am 95% certain of it. If true we just need to wait for Obama to sign it.

A few that posted here earlier have said that their issues were fixed today. Hopefully the ball will keep rolling now.
