The end of a benefit year trumps everything else. Regardless of how much money you have left on your claim or how many weeks you have left to file, when the benefit year ends, that claim is done.

You will need to file for a new benefit year if you wish to continue drawing unemployment benefits. If you have enough wages in the base period to qualify for a new, regular UI claim, that's what will happen (along with a new waiting week). If not, then they will transfer any unused extension money to your new benefit year for you to draw (with no waiting week).

Keep in mind that your new benefit year weekly benefit amount may be lower (or higher) than the benefit year that just ended. It's all based on work and earnings in the base period. Right now a claim filed would be based on earnings from all four quarters of 2009.

Hi jdljr,

Hope you are well! I have not been on here for a while, but you checked some weeks ago for me to verify the amount in my account b/c I kept getting a message saying I had 2 weeks or less remaining. The amount you told me agreed with what I expected PLUS another $290 for week #14.

Here is where it gets dicey for me. My Tier 3 exhausted the week ending April 3rd. Yep, April 3rd. I thought this was the criteria for advancing to the next level, which for me would be week 14. So, I certified yesterday, thinking I would be paid for week #14 today, but I just checked and it did not pay.

Was my interpretation wrong? Or, am I another glitch? Not sure what to do here & would appreciate your assessment of the situation.

Hello, i have some questions im hoping someone can help me with.Last year my benefit year ended right after xmas and i was told i had to open a new year to continue to claim UI.But i was in the middle of tier 2 when i had to start a new year(i only collected 2 weeks of tier2).I qualified for a whole new UI claim because of money i had earned before i was laid off in late 08.Today congress voted yes to continue forward with the bill, but that could take at least 2 weeks before everything is passed and ready to go(maybe i really dont know just a guess).My question is shouldnt i be able to jump back to last years tier2 without being affected by congress lack of action?From what ive read i should be able to but i must have the worst luck when calling unemployment office.I talked to 4 different people last week and one lady said i should be able to but didnt know why it wasnt rolling over.Another lady told me that EUC and EB were the same thing which i know isnt true so its hard to put stock in what those people say.I just want to know if i can roll back to last years EUC or do i have to wait for the extension bill to go through.

Hey Deerest,

There are a lot of claims that just stopped 4/3 when they exhausted a particular tier. I've had to do transactions on probably a dozen or so to get them kicked back in.

In your case, you probably have a 15 code on the w/e 04102010 (all the others that I've seen stuck had this). A rep needs to do an "A1" transaction. But here is where I am not quite sure. I tried one for tonight exactly in your situation and will know tomorrow whether it worked. Because I am trying to get Tier 2 to kick back in to pay that one week, I put the old Tier 2 effective date (from the B.46 screen) in the "Old Tier II" field, and 04042010 in the "New Tier II" field...sort of telling it to make Tier 2 effective 4/4. Not sure it's going to work, I have to check it tomorrow. I know it works for going from regular UI to Tier 1, and I was told the other tier "fields" on the A1 screen should work now, but I hope the system won't think I'm trying to do something strange to go back and pay Tier 2 AFTER Tier 3 has exhausted (but there is still that one week).

Also, because the Tier 2 "14th week" is just that one week, I think your claim will stop again after that because then, essentially, you did not exhaust that tier by 4/3 to move into Tier 4. So you may have to have someone try a B1 transaction next week (if the A1 works this week) to get EB to kick in (if eligible). Otherwise, you'd have to wait until Congress extends the phase out date and then pick up your Tier 4.

These are some tricky times right now. I'll honestly say there are MANY of us (myself included) that are not sure exactly what people are eligible for during this time of waiting for Congress to act. My Regional Claims Specialist has made several references to people collecting EB while they're awaiting the phase out date to be extended. But the problem is, if you received regular UI in a 2nd benefit year, they don't pull forward EB. So not sure that you would qualify there.

And I don't know about folks having pull forwards while awaiting the phase out date to be extended. I think ESC is still evaluating the legislation to see if that's something that's possible with the phase out date having passed.

You may very well have to wait until the phase out date is extended. Then when it is, either you'll begin with Tier 1 again if you qualify for new extensions, or they'll do a pull forward of your EUC from your previous benefit year, if you don't qualify for new extensions. It just isn't real clear.

Just out of curiosity....I thought once your claim year expired, you HAVE to file a new claim & if eligible, you had to exhaust the regular UE & any extensions in the new bene year before you could pull forward any unused benes from the first year. Am I wrong about that?

I was in the semi-middle of EUC Tier II in March, and then was required to start a second benefit year, as the first ran out last mo. I was receiving much higher payments via Tier II, which would've lasted through May. In opening a new benefit year, I am now receiving 16 weeks at a reduced rate (like a "regular" claim). I'm not counting on anything beyond this.

Deerest,

I was receiving EUC Tier II in March, when my benefit year ran out, or claim year expired. I was receiving the max. weekly amount.

EUC Tier II would've lasted through May. However, since I qualified for a second benefit year, I was forced to start a new "regular" claim in a new benefit year.

EUC did not pull forward. Rather, I now receive a reduced weekly amount for a duration of 16 weeks.

If a person is allowed to pull forward during a second benefit year any unused amounts from EUC during the first benefit year, what weekly benefit amount does the person receive--the amount from the first year or from the second benefit year?

I received the max weekly amount during the first benefit year and during EUC, which I collected partially through Tier II. I was forced to open a second benefit year and qualified at a majorly reduced weekly benefit.

I am planning on falling off the unemployment roll after my initial 16 weeks are complete in this second benefit year at this point--if still unemployed.

Eb does not pull forward. In other words you would have to qualify or and exhaust all available extensions in the new year to get eb.

I think you said that you had already gtten 5 weeks of tier 2 so youd have 8 or 9 left and then tier 3 and 4.
Remember though that all of this is contingent on Congress passing an extension. Currently all euc benefits expired on 4/5/10. This means tht you can only draw whatever tier you are currently on until and extension is passed. Everyone believes this will happen. No one knows when.

When they missed the deadline last time it took three weeks for them to get me back into the system and payment to take place. They did, however, pay me all three weeks at one time.
