careless/reckless driving.. let me guess. you were going over 100mph? Contact a lawyer or response to one of the solicitation you will receiving in the mail.
I'm guessing his math skills are better than his ability to read a speedometer
I have no experience in this, less seriously things the ADA is generally willing to plea bargin down. I'm not sure what they'd do on something like this and the financial penalty of increased insurance will likely be severe enough to warrant getting at least an attorney's opinion.
Definitely get a lawyer, they will be sending you envelopes to your house soon. Talk to them and select the one you like best.
It will cost you, but I wouldn't even think of going into court by myself for these charges.
If you have a clean license, you will probably get a reduction in points.
good luck
39:4–98 Exceeding maximum speed 1-14 mph over limit 2
Exceeding maximum speed 15-29 mph over limit 4
Exceeding maximum speed 30 mph or more over limit 5
The only other thing I see is "Racing on a highway" which is 5 points.
You were going over 95 MPH? The 2 points extra may have been from you tearing around traffic, OR it could have been that you were up over 100 and there is no further (that I can see) penalty for that.
He wasn't charged with reckless, he was just issued a careless driving ticket in addition to the 5 point speeding charge. No matter what, get ready to pay big bucks (speeding fines are doubled in a 65) and hire a lawyer. I'm not sure what the "drop dead number" is for points on an NJ license, but I wouldn't want to deal with 7 points at once. The lawyer should be able to do a song and dance and knock some of the points off, at least. Chances are they'll reduce it, but the fines are going to be pretty big no matter what.
Normally, I never advise people to hire an attorney for speeding tickets, but it sounds like this guy was not only speeding, but driving stupidly enough to **** off the cop to cite for careless as well. Calm down out there, buddy.
12 points is suspension. Follow the link VD if you want more info. I tried to find the fines, but I think that might be local (although the state should have ones for state roadways...)
With an attorney, they may knock off the careless (2 points) and have you pay a few hundred dollars in place of it. The 5 points is going to be hard to reduce as a 7 points citation is very severe.
No matter what, it's a huge difference between 5 versus 7 points. 6 points and more, you are looking at surcharges for your driving priviledges.
Get some legal advice from an attorney and proceed from there. Consider it an expensive lesson. Look on the bright side, this may have been a cheaper lesson considering that this didn't resulted in a big accident from your recklessness.
7 pts and you're not even going to tell us what you were doing?
Do you think the lawyer is going to do a lot more than you can do representing yourself?
How much are the fines? How much is a lawyer ($800?)? How much is your insurance going to go up?
