Towns can do so in a limited fashion, such as prohibiting certain types of establishments within the proximity of places like schools or churches. But the proximity restrictions cannot be so broad as to make it a de facto prohibition throughout the town.

Zoning laws have been well tested. Towns can limit certain things but you can't say they can build say a Chipolte but not a Popeyes. That is illegal. Both serve legal foods so there are no grounds for denying one but not the other. It does not work that way. A property owner does not even have to identify what business will occupy the building. Just what the business does. Jay

Was in the area today... Route 7 near the Merritt 7 Offices. Land for sale.


Hard to see but there's a steep hill. Not a lot of flat space in front so they would have to blast. Not sure how far back the hill goes.

Hasn't that property been for sale for a while now. I don't get that way often but I seem to remember it being for sale before. Anything built there would have to blast a lot or hand the buildings off the side of the hill there. Not an easy site. Jay

Over a year for sure. Maybe 2 yrs? Wonder who owns it.

There's another piece of land for sale down the road.


I believe this is the spot BJs found resistance from residents and decided against it.

Here is an update on the SoNo Collection. It is being billed as the Mall of the Future and should be pretty nice even though the size has been scaled back with the elimination of the hotel component. Still 2 years away from opening though. Anxious to see if it is as good as it claims to be. Jay

Wow.
They should fire the person that did the original estimate. That is a huge difference. Of course they could just went more upscale with the project but still 84% is a lot. Jay

So glad to see the SoNo Collection is moving along nicely. Even I was a bit skeptical that it would ever get built given the retail crisis across the country these days. Who would have thought anyone would be able to build a new shopping mall these days. Malls in other parts of the country are closing. Anyway, look forward to seeing this when it is completed in 2 years. Should be interesting. Jay
