Anyone who tries to intervene in a crime in NYC is a flat-out idiot. If it doesn't involve you, leave. No matter what is occurring or who the victim is.
In the past year, I've quickly removed myself from two situations where people were asking for help. The second one happened like 2 weeks ago. My conscience is 100% clear. This is the world we live in now.

threatened ? being scared doesn’t qualify for deadly force
that might qualify for physical force if he put his hands on someone first , but even that didn’t happen.
Physical force is allowed if it’s imminent. Doesn’t matter about putting hands on someone first .If someone squares up with you your saying you can’t hit them unless they hit them first? What if they are in the process of swinging? Can you hit them first at that point?
Doesn’t apply here it seems obviously. We’ll see what happens with the evidence.
Is the choke hold considered deadly automatically? Reason I ask is what if it was one punch that resulted In the death here ? Does the punch turn to deadly force automatically?
Standing up to do the right thing would have been to sneakily push him off the train at the next stop when the doors opened. I've seen it done a few times to a few kooks. Not killing him. Would you have exerted the same force as Penny if you were on that train?

Dead on. Sorry this is what the city wants and voted for, so it’s me and mine first. That’s just sad reality.
Until the person falls and hits their head and dies and your arrested and right back in this situation.
