based on ayoobs criteria, penny blew it .

there were no weapons involved and there clearly was no disparity in force as penny had the upper hand the whole time .

physical force was warranted but not deadly force . when physical force turns deadly but wasn’t supposed to , that’s manslaughter…

Standing up to do the right thing would have been to sneakily push him off the train at the next stop when the doors opened. I've seen it done a few times to a few kooks. Not killing him. Would you have exerted the same force as Penny if you were on that train?

Lots of lawyers want the case to continue which is why judge won't dismiss it. Has nothing to do with justice. If it was a white homeless person they would dismiss it because there's no fervor and no greedy lawyers willing to look at it. There is no fairness in our judicial process, it's all about greed.

I would question if even physical force was warranted. He didn't touch anyone nor did it appear that he targeted any specific passengers with implied or direct threats of violence nor was he damaging anything in the train.

it would have been at least no more then an assault charge at best if penny struck first . but deadly force according to the accepted criteria used in self defense cases as presented by ayoob showed no reason for deadly force to be used .

i keep saying , i think they will find him guilty of manslaughter and rightfully so …it doesn’t meet the definition of using lethal force.

no weapons introduced, no disparity in force , if anything penny had the greater force

he is brilliant when it comes to that stuff . but it isn’t just tactical training he is great at , it is his court room presentations and legal defenses..as well as teaching us how to approach different situations from a legal perspective.
