He strangled him for 15 minutes and ignored warnings from another passenger that he was killing him, what did he expect. Was this guy living under a rock in 2020 ?

he just got caught up in the moment and someone died as a result of it … he isn’t being charged with murder… manslaughter means you were responsible for a death that shouldn’t have happened as a by product of your actions.

Not only should he have known, he was trained in the use of deadly force in the Marines. A civilian without such training could claim they didn't know the risk but he was specifically trained in how to use deadly and non-deadly force. He could have been charged with more serious crimes.

He should have been more trained about attacking a black man vs anyone else. Rules are a bit different in that setting.

Sounds crazy to most regular people but you can see even in the responses to this thread that this is what the people and voters in NYC want to see happen.

that is just blatantly false .

all states have laws that govern the use of deadly force and there is no state penny likely wouldn’t be charged in .

if you listen to the videos , the basic criteria needed to use deadly force wasn’t present and you can see why he is charged …it has nothing to do with voters .

the laws are the laws across the country for the most part and the tests needed to use deadly force and not just physical force are there for a reason

there was no weapons and no disparity in force at any point as penny clearly had the upper hand …he made a poor choice and will now have to hope a jury doesn’t convict him on manslaughter , which i believe they should as he clearly falls within the definition of it

No jury is going to convict this man.

This reminds me of the NYC cashier who had to stab a robber to death, DA brought up charges, there was outrage, then they dropped the charges.

That's called self defense. You defend yourself until the threat is eliminated.

His courage saved countless lives that day and no jury would convict that.

Please stop with this sort of talk.

I am very sympathetic to the Marine. Yes he made a tragic mistake, he crossed the legal line. I agree with this. But common sense has to come into play I would hope.
