Incredible responses here - there seems to be more sympathy here for the arrested teenager than the classmate who was bullied online. We know that nothing will happen to the teenager. He won't go to jail. He won't have a record. But maybe he can learn a lesson in civics and how to talk to people before he gets himself hurt. And, calling someone fat vs a racial slur is a very different class of insult.

But they are not making bullying and name calling illegal, just racial slurs. I don't know what the statistics are on teenage suicide, but is being called a racial slur why kids commit suicide??

No, it's the underlying bullying that's the issue. And bullying, particularly the online variety can be illegal depending on where you are. If the teenager was smart (while being a racist jerk), he should have just said the racial slur to the other kid's face. There would have been no charges.

Online bullying is bad and should be discouraged. But simply taunting someone with words should not be criminalized. That is unconstitutional. The bully is getting more sympathy because it appears his constitutional rights are being violated here, while that does not appear to be happening to the victim.

Really? Does it hurt less or more? Often kids who are overweight are dealing with emotional issues so I'm going with "hurts more". If fat insults are ok, why not insults of the physically or intellectually disabled?

I'm not saying bullying isn't the underlying issue, of course it is.
Bullying leads to suicide, when have kids committed suicide because someone called them a racial slur? I think it's extremely rare that kids spouting ignorant racial slurs lead to suicide. Because when you hurl a racial slur, every other kid of your same race supports you, and denounces the slur, and pushes back against the person spouting the slur.

Laws curtailing free speech are not going to be allowed ultimately by the SCOTUS. As I’ve pointed out before, the SCOTUS voted 8-1 to uphold the free speech rights of the Westboro Baptist Church, purveyors of some of the most strident hate speech we’ve seen in this country in recent years.
the kid who bullied the other kid is a jerk, but he didn't break the law. words are free speech. arresting the kid for saying despicable words is indefensible.
