You are exactly right. It would be a violation of the right of freedom of speech. One may not like the message on someone else's clothing, but they cannot ask them to leave a store because of the message on a T-shirt.
Real sexual harrasment, where there is verbal exchange, physical touching and such, is one thing. But there is no Constitutional right not to be offended by something.
Some might be offended by a woman or young girl wearing clothing that exposes too much breast, or a skirt that is so short that it arouses. We see these things all the time. Are we going to require women to cover up, as they do in Muslim countries? I don't think so.
This thread is just plain silly. From me, it gets a great big
You don't have freedom of speech inside of a wal mart... wal mart is a private business not a government or public property.
and other things you have said are wrong too...I suggest you ask for a refund from the law school you went to....
Translate that into "as per my usual MO, I'm gonna toss out some outrageous thought that's tenuously related to the actual topic to see if I can stir the pot."

You are totally clueless. I finally got a hold of a senior management type at the local Wal-Mart where I had complained about the young man wearing a shirt that read, "I F*** on the first date." I complained to a Wal-Mart Assistant Manager at the time and she told me there was nothing that could be done. Turns out that Assistant Manager was also totally clueless. The Senior Manager told me the Assistant Manager on duty that day was wrong and should have asked the young man to leave or turn his shirt inside out. Wal-Mart doesn't need the sexual harassment argument to do this. This gives them more leeway since many obscene shirts don't meet the standard for sexual harassment.
BTW, the Senior Manager also told me they do indeed ask scantily clad young women to leave or cover up.
It's good to know that Wal-Mart enforces some standards of civility.
"Sexual harassment of Wal-Mart employees by customers"
So what do you want? A T-shirt police force in every public place and business?
They are already there. They are called "management."
