Me I sent over my paper for my proposed DQ. To the DSNY appeals department. I resubmitted the same 3 letters I gave them in the first place. My statement, and today I seen other specialist I got a new clearance letter, then I also gave one from my primary care doctor. Now I just wait for the outcome and if they finally DQ me that's when I am going to appeal with civil service commission.
F**K Dr. Astria! She said I have Bilateral Hip Osteoarthritis (without sending me any proof by the way) I'm getting my X-Rays, my Doctor's Verification and Appealing!
She called me a liar saying I had an injury because I wasn't "very flexible". I didn't know Pilates was a PreReq for DSNY. I did 7 years of the Army just fine, nothing hurts.
So what lawyer do any of you suggest?
Also, and I'm pissed, I know doctors are held to account for a bad diagnosis, so am I able to hold her acoountable, personally for lost wages?
What the heck were you not able to do? I was not able to touch the floor, i was off by an inch or so and all she told me was that i needed to lose weight.
She shoved her thumbs in my eyeballs for some reason, had me squat, bend and reach, then starting poking in my belly button, **** hurt. Nothing too off the wall until she asked me to lie on my back and put my knees to my chest, I was able to get a good acute angle but, she said "there sonthin you not terring me, you have injuly". Nothing hurt, never did.

In all honesty she is f**ing crazy, I had a stiff neck for almost a month because of the way she tested. When she had you move your head from side to side and then kept saying faster faster faster. I definitely tweeked a muscle i my neck. What the hell does someone doing that accomplish, most doctors just make you bend and tilt your head to make sure you have full motion.
I'm not quite sure where to begin...I shall proceed politely
Sanitation is a job. The city is an employer. Just like any other job from any other employer...they have a hiring process. Similar to others...except to go work at McDonald's maybe you sit and chat with the owner, here you do other stuff. And the same way McDonald's might say...no I'm sorry we don't want you, the city may also. Take the paperwork to your physician now. And tell him AWOL sent ya

They're possibly intentional but, that is exceedingly difficult to prove, and even if I can I'm the party primarily responsible for my wages. So I focused my priorities and got a job lined up while this appeal clears. Well, also, the doctor I use is on Ave Z. near Ocean Ave but, is there any in particular doctor and or lawyer you would suggest?

Any doctor that can prove her findings are false is fine. Don't worry about an attorney unless they officially DQ you, It is a waste of money you can save to use if you have to go to the civil service commission.

For me I had a really nice doctor and he even ended the exam by saying "I don't see any reason to keep you from being a Sanitation Worker, Good luck" and shook my hand as I walked out.
The nurse, who was also awesome, went over all my tests at the end and said "Looks good and good luck"
As it was said numerous times in the past posts...Lots of people got skipped due to no CDL/medical DQ for the July class....For august class they are starting back at number 1 and going through everyone they skipped...Lots of people got their CDL by now (due to the CDL training by DSNY)....You can't assume that since they went through 500 people for July, that they will go through another 500 people for August...There's even a chance that after August class gets filled the list won't even budge past 500. If you got your CDL and passed your medical then all you can do is patiently wait to see how the list moves after each class....Usually 1-2 weeks before each class is about to start you can get the idea of what number they get up to.
