It's been attempted. The cops, being at the time only ordinary citizens and not yet endowed with today's unconstitutional powers, found that it applied to them as well... so they could no longer get evidence via dumpster-diving (or blue-barreling as it's called hereabouts). Anyway I forget how the fight went but it proceeded upward to some level of supreme court (don't recall if state or SCOTUS) and the decision was that if your trash is in a public place like an alley, anyone can DD. And if the cops can do so without a warrant, so can anyone else.
