So in fact cjski really does not have a basis to give a ticket to anyone who claims to be a seasonal resident. In fact on the plain language "seasonal resident" overrides any of the other causals.

Now cjski, as a matter of police force policy, may give such a ticket anyway and let the court sort it out. But in doing so he is, in fact, violating the statutes.

I doubt it is criminal but he or his department or both could be sued for damages. Might even get it into Federal court.

Now would that not be fun...
Use the words in the statue and you wont get a ticket. What I am talking about is the people like this.

"Good morning sir/ma'am"

"Hey. I'm sorry. I'm just in a hurry to get to work."

"I noticed you have out of state plates"

"yeah I just moved here"

"Oh yeah? Welcome to Las Vegas. How long have you been here?"

"Almost 3 months"

"Oh? Well were you planning on registering your car in Nevada?"

"yeah, but I was going to wait for these to run out"

"Well, sir/ma'am, let me explain something to you."

Add any number of expletives and rude comments thrown in my direction and you have a typical traffic stop. 99% of the people are not seasonal, they are not visiting. In fact, most tell me they were in a hurry to get to work as soon as I walk up to the car because they think they were speeding. I don't care you were speeding, I don't even have radar in my car.

It will not go to federal court, because I work for the City of North Las Vegas (not the State of Nevada, we are dealing with a state law and a city law attached to it) and our Police Chief has given us permission to do just that.

Only a theoretical cjski...but it could well end up in Federal Court. It is a civil dispute between the City of NLV and a resident of another state.

Practically it would occur only if someone capable of per se representation in Federal Court got really annoyed with NLV or you. Economically it would be a hopeless loser. This is the sort of thing brought by special interest groups looking for injunctive relief. But I can't think who would care if NLV is not nice to snowbirds.

So only of interest in the theoretical sense.

I can see if someone was RELOCATING permanantly to Vegas, but thousands of people have left homes, wives, husbands, and children in their home state to go and work there. That does not constitute becoming a resident.

Here's a new slogan for the tourism industry: Visit Las Vegas - The Trailer Park of the West! It's like you've never even left home!!!!

Just my 2 cents.....
It was the law in every state I've lived in too so you seem to be just using that as another reason to attack Nevada just because you didn't like living here. By the way: we didn't like having you here either.

That's the way it should be handled and it is what I've been hoping you guys would do for years. They know better but just want to get away with living off of us. Along those lines, do you know how many people come here from other states to sign up for welfare? I can see coming here for work...but welfare?

I am confident it would be unconstitutional to stop a vehicle merely because it bears an out of state plate. If there is, in fact, an existing policy to that effect, regardless of who issue it, the ACLU needs to challenge it. Please don't deride me because I believe in preserving the US Constitution. These are our rights and if we stop standing up for them the US will become a police state. Think about it.
