Legally, here in the US, no ethnic group is treated differently from any other in regard to property rights. There ARE differences in the way citizens and non-citizens are treated. This has been covered extensively in previous posts.
If North Carolina were a sovereign nation, then it would be legally entitled to regulate who immigrates there. However, it is not--North Carolina is a state, and states, under our laws, may not regulate who is allowed to "settle" there. That is the job of the Federal Government.
If North Carolina were a nation, it would of course be allowed to build anything it wanted, within its own territory. But it's not, so it can't.
As the North Carolinians might say, "If my aunt was a Man, she'd be my Uncle--but she ain't, and she's not"....
BTW, if the DOI stated that "All men are created equal", how is it that women can own land? And why doesn't Wilfred Brimley look like Brad Pitt?
The Federal govenment has no jurisdiction over who can live in what state. These powers rest with the states themselves. The Feds do have some leverage via federal funding, but no legal authority. So, the hypothetical is possible but highly unlikely.
