    Observation: Containers of dry goods such as granola, flour and spices are not identified with the common name of the food.
    Correction: Except for containers holding food that can be readily and unmistakably recognized such as dry pasta, working containers holding food or food ingredients that are removed from their original packages for use in the food establishment, such as cooking oils, flour, herbs, potato flakes, salt, spices, and sugar shall be identified with the common name of the food. Consumers may be allergic to certain foods or ingredients. The mistaken use of an ingredient, when the consumer has specifically requested that it not be used, may result in severe medical consequences. The mistaken use of food from unlabeled containers could result in chemical poisoning.

    Observation: Food containers of rice, chicken, and vegetables was not arranged to provide maximum heat transfer and/or loosely covered, or uncovered while cooling.
    Correction: When placed in cooling or cold holding equipment, food containers in which food is being cooled shall be: (1) Arranged in equipment to provide maximum heat transfer through the container walls
  • Time/Temperature Control for Safety Food, Cold Holding (corrected on site) (repeated violation)
    Observation: Several items on mainline prep unit and pizza prep unit are cold holding at the improper temperatures of: chicken 56F, Parmesan cheese 50F, steak 50/54F, sausage 56F, cheese 57F, pepperoni 61F, bacon 62F, chicken 60F, veggie medley 47F. Corrected by discarding.
    Correction: Except during preparation, cooking, or cooling, or when time is used as the public health control as specified under section 3-501.19, and except as specified under paragraph (B) of this section, time/temperature control for safety food shall be maintained at 5ºC (41ºF) or less. Bacterial growth and/or toxin production can occur if time/temperature control for safety food remains in the temperature "Danger Zone" of 5ºC to 57ºC (41ºF to 135ºF) too long. Up to a point, the rate of growth increases with an increase in temperature within this zone. Beyond the upper limit of the optimal temperature range for a particular organism, the rate of growth decreases. Operations requiring heating or cooling of food should be performed as rapidly as possible to avoid the possibility of bacterial growth.

    Observation: Food packaged in the establishment is not labeled as specified in law. Muffins, cakes, and other baked goods have no labels or identification.
    Correction: Food packaged in a food establishment, shall be labeled as specified in law, including 21 CFR 101 – Food Labeling, and 9 CFR 317 Labeling, marking devices, and containers. The identity of a food in terms of origin and composition is important for instance when a food may be implicated in a foodborne illness and for nutritional information requirements. Ingredient information is needed by consumers who have allergies to certain food or ingredients.
  • Equipment/Good Repair and Proper Adjustment
    Observation: The Beverage Air 2 door reach in units are not maintained in a state of repair and condition that meets the requirements of materials for construction and repair and/or design. The gaskets are in need of repair in both of them.
    Correction: Equipment shall be maintained in a state of repair and condition that meets the requirements specified under Parts 4-1 [Materials for Construction and Repair] and 4-2 [Design and Construction]. Proper maintenance of equipment to manufacturer specifications helps ensure that it will continue to operate as designed. Failure to properly maintain equipment could lead to violations of the associated requirements of the Code that place the health of the consumer at risk. For example, refrigeration units in disrepair may no longer be capable of properly cooling or holding potentially hazardous (time/temperature control for safety) foods at safe temperatures.
  • Equipment, Food-Contact Surfaces, and Utensils
    Observation: The food-contact surfaces of the can opener and several utensils stored as clean are not clean to sight and touch.
    Correction: Equipment food-contact surfaces and utensils shall be clean to sight and touch. The objective of cleaning focuses on the need to remove organic matter from food-contact surfaces so that sanitization can occur.
  • Equipment/Food-Contact/Before Use After Cleaning/Sanitized (corrected on site)
    Observation: Utensils and food-contact surfaces of equipment were not sanitized after cleaning. Observed employee washing/rinsing and not sanitizing equipment and utensils.
    Correction: Utensils and food-contact surfaces of equipment shall be sanitized before use after cleaning. Sanitization is accomplished after the warewashing steps of cleaning and rinsing so that utensils and food-contact surfaces are sanitized before coming in contact with food and before use.
  • Backflow Prevention Device, Design Standard
    Observation: The backflow or backsiphonage prevention device installed on the mop sink does not meet American Society of Sanitary Engineering standards.
    Correction: A backflow or backsiphonage prevention device installed on a water supply system shall meet American Society of Sanitary Engineering (A.S.S.E.) standards for construction, installation, maintenance, inspection, and testing for that specific application and type of device. In some instances an air gap is not practical such as is the case on the lower rinse arm for the final rinse of warewashers. This arm may become submerged if the machine drain becomes clogged. If this failure occurs, the machine tank would fill to the flood level rim, which is above the rinse arm. A backflow prevention device is used to avoid potential backflow of contaminated water when an air gap is not practical. The device provides a break to the atmosphere in the event of a negative pressure within the system. Minerals contained in water and solid particulate matter carried in water may coat moving parts of the device or become lodged between them over time. This may render the device inoperative. To minimize such an occurrence, only devices meeting certain standards of construction, installation, maintenance, inspection, and testing for that application may be used. The necessary maintenance can be facilitated by installing these devices in accessible locations.
  • Refuse/Covering Receptacles (repeated violation)
    Observation: Receptacles and/or waste handling units for refuse, recyclables, and/or returnables kept outside the food establishment are not kept covered with tight-fitting lids or doors.
    Correction: Receptacles and waste handling units for refuse, recyclables, and returnables shall be kept covered with tight-fitting lids or doors if kept outside the food establishment. Outside receptacles must be constructed with tight-fitting lids or covers to prevent the scattering of the garbage or refuse by birds, the breeding of flies, or then entry of rodents.
  • Refuse/Frequency/Removal
    Observation: Refuse, recyclables, and/or returnables are not removed at a frequency that minimizes objectionable odors and/or attraction/harborage of insects and rodents.
    Correction: Refuse, recyclables, and returnables shall be removed from the premises at a frequency that will minimize the development of objectionable odors and other conditions that attract or harbor insects and rodents. Refuse, recyclables, and returnable items, such as beverage cans and bottles, usually contain a residue of the original contents. Spillage from these containers soils receptacles and storage areas and becomes an attractant from insects, rodents, and other pests. The handling of these materials entails some of the same problems and solutions as the handling of garbage and refuse. Problems are minimized when all of these materials are removed from the premises at a reasonable frequency.
  • Handwashing Cleanser, Availability
    Observation: A supply of hand cleaning liquid, powder, or bar soap is not provided at each handwashing sink. No soap at kitchen hand sink.
    Correction: Each handwashing sink or group of 2 adjacent handwashing sinks shall be provided with a supply of hand cleaning liquid, powder, or bar soap. Hand cleanser must always be present to aid in reducing microorganisms and particulate matter found on hands.
  • Hand Drying Provision
    Observation: Each handwashing sink is not provided with individual, disposable towels
    Correction: a continuous towel system that supplies the user with a clean towel
  • Handwashing Signage (repeated violation)
    Observation: A sign or poster that notifies food employees to wash their hands is not provided at all handwashing lavatories used by food employees and/or is not clearly visible to food employees. No handwashing sign at kitchen handwashing sink.
    Correction: A sign or poster that notifies food employees to wash their hands shall be provided at all handwashing sinks used by food employees and shall be clearly visible to food employees. A sign or poster is required to remind food employees to wash their hands.
  • Mechanical/Ventilation
    Observation: Mechanical ventilation of sufficient capacity is not provided to keep the restroom free of obnoxious odors, smoke, and/or fumes.
    Correction: If necessary to keep rooms free of excessive heat, steam, condensation, vapors, obnoxious odors, smoke and fumes, mechanical ventilation of sufficient capacity shall be provided. When mechanical ventilation is necessary, it must have adequate capacity to ensure that soiling of walls, ceilings, and other equipment is minimized

    Observation: Observed some ceiling tiles in poor repair. Observed some grout missing in areas in kitchen.
    Correction: Physical facilities shall be maintained in good repair. Poor repair and maintenance compromises the functionality of the physical facilities. This requirement is intended to ensure that the physical facilities are properly maintained in order serve their intended purpose.
  • Poisonous or Toxic Materials/Common Name/Working Containers (repeated violation)
    Observation: Working containers used for storing poisonous or toxic materials are not clearly and/or individually identified with the common name of the material.
    Correction: Working containers used for storing poisonous or toxic materials such as cleaners and sanitizers taken from bulk supplies shall be clearly and individually identified with the common name of the material. It is common practice in food establishments to purchase many poisonous or toxic materials including cleaners and sanitizers in bulk containers. Working containers are frequently used to convey these materials to areas where they will be used, resulting in working containers being stored in different locations in the establishment. Identification of these containers with the common name of the material helps prevent the dangerous misuse of the contents.
  • Pesticides/Restricted Use Pesticides, Criteria (corrected on site)
    Observation: Restricted use pesticides do not meet the requirements in 40 CFR 152. Raid was observed stored near the 3 compartment sink.
    Correction: Restricted use pesticides specified under paragraph 7-202.12(C) shall meet the requirements specified in 40 CFR 152 Subpart I - Classification of Pesticides.

    Observation: A food employee failed to wash his or her hands before engaging in food preparation after handling soiled swinging door.
    Correction: Instruct food employees to clean their hands and exposed portions of their arms immediately before engaging in food preparation including working with exposed food, clean equipment and utensils, and unwrapped single-service and single-use articles (A) After touching bare human body parts other than clean, exposed portions of arms (B) After using the toilet room (C) After caring for or handling service animals or aquatic animals as specified in 2-403.11(B) (D) After coughing, sneezing, using a handkerchief or disposable tissue, using tobacco, eating, or drinking (E) After handling soiled equipment or utensils (F) During food preparation, as often as necessary to remove soil and contamination and to prevent cross contamination when changing tasks (G) When switching between working with raw food and working with ready-to-eat food (H) Before donning gloves for working with food and (I) After engaging in other activities that contaminate the hands.

    Observation: The following foods were observed at improper cold holding temperature:
    1. Tuna salad (51F - uncovered) and Beef steak (49F - plastic bags opened

    Correction: moved into WIF)
    2. Carmalized onions (64F), cheese (57F) and Pepperonis (65F) on top portion of "Kairak" 1-dr prep refrigerator - (all the foods were discarded)
    3. Salmon (45F) and Feta cheese (47F) in "Bev Air" 2-dr prep counter refrigerator - (uncovered)
    4. Steak (56F), Feta cheese (47F), Blue cheese (50F) and Tomatoes (45F) on salad prep refrigerator on line - (relocated into WIC)
    5. Sliced ham (54F) and Tuna salad (48F) on sandwich prep refrigerated line - (relocated into WIC). The unit was iced up.
  • Nonfood-Contact Surfaces/Nonabsorbent (corrected on site) (repeated violation)
    Observation: The nonfood-contact surface of the milk crates used for shelving and storage, and wet towels used under cutting boards, is not corrosion-resistant, nonabsorbent, and/or smooth.
    Correction: Nonfood-contact surfaces of equipment that are exposed to splash, spillage, or other food soiling or that requires frequent cleaning shall be constructed of a corrosion-resistant, nonabsorbent, and smooth material. Nonfood-contact surfaces of equipment routinely exposed to splash or food debris are required to be constructed of nonabsorbent materials to facilitate cleaning. Equipment that is easily cleaned minimizes the presence of pathogenic organisms, moisture, and debris and deters the attraction of rodents and insects.
  • Sanitizing Solutions, Testing Devices (corrected on site)
    Observation: A test kit or other device that accurately measures the concentration of the quat sanitizing solution is not provided.
    Correction: A test kit or other device that accurately measures the concentration in mg/L of sanitizing solutions shall be provided. Testing devices to measure the concentration of sanitizing solutions are required for 2 reasons: 1. The use of chemical sanitizers requires minimum concentrations of the sanitizer during the final rinse step to ensure sanitization
  • Critical: Sanitized/Hot Water and Chemical/Methods (corrected on site)
    Observation: When tested, no sanitizer or a low concentration of chemical sanitizer was found in the sanitize basin.
    Correction: Provide quat ammonium sanitizer at proper concentration of 200-400 ppm and immerse or expose food contact surfaces to sanitizing solution for adequate time.
  • Handwashing Sink/Using/Operation and Maintenance (corrected on site) (repeated violation)
    Observation: The front handwashing sink is used for purposes other than handwashing (rinsing wiping towels).
    Correction: A handwashing sink may not be used for purposes other than handwashing. Sinks used for food preparation and warewashing can become sources of contamination if used as handwashing facilities by employees returning from the toilet or from duties which have contaminated their hands.
  • Plumbing System/Maintained in Good Repair
    Observation: Mop sink faucet obsered leaking.
    Correction: A plumbing system shall be maintained in good repair. Improper repair or maintenance may result in the creation of obnoxious odors or nuisances, and may also adversely affect the operation of warewashing equipment or other equipment which depends on sufficient volume and pressure to perform its intended functions.
