Not really, a case like that would be dismissed based on the doctrine of primary assumption of risk. Not to say an insurance company wouldn't settle it to avoid legal fees, but you wouldn't ultimately win if it goes all the way to trial.

but, it was also "an attractive nuisance" , I think.
