I signed a lease while the landlord was still occupying the house. I was not afforded an actual walk through. If I had, I wouldn't have signed the lease. The lease states if I want to shorten the term, I will pay a one month reletting fee. I didn't move in until after the couple left out of state. I am finding many areas of the home that are absolutely inexcusably filthy and damaged. I have decided to shorten my lease. Must I pay that one month rent for reletting? I don't believe he fulfilled his landlord duties in making the home clean before I moved in.

I'm no lawyer but I believe it's part of Texas rules that you be afforded a standardized form for you to list the defects found in the house. If that was not done there could be some ramifications for the Landlord. Although the doesn't mean necessarily that you can void the least on your say so alone. It would need to go the the JP court at least.
Also could possibly depend on the lease and the time that has passed. If you singed a lease that states you agree the home is in acceptable condition, you may have issue with or without the walkthrough. Also, if you don't have photos taken within a few days of the move in,you may have issues convincing any court that the damage was there before you and not caused BY you.
