The senate that confirmed Thomas had 57 democrats / 43 republicans.

The ABA endorsed Thomas as qualified.

Bush I was roundly castigated by conservatives for previously nominating David Souter, who by all accounts was neither conservative or liberal. Shocking!

Sorry if all this "grey area" thinking is making your head hurt. Just funny that the Dems could have EASILY stopped Thomas' nomination and didn't.

I'd love to hear some intelligent discussion of this.

Interesting. Yet Uncle T only passed by a vote of 52-48, the narrowest vote in a century. If you'll notice, many of the Democratic votes came from Southern senators. Perhaps these Dems didn't want to antagonize black voters (a large voting bloc in their states). Even though Thomas pretends like he's not black, there was a lot of drama in T's hearings from Anita Hill testimony, etc. Of course, Uncle T pulled the race card (he is only black when it's to his benefit) and called it a "high tech lynching", knowing how that phrase would stick in the minds of most black ppl, espec those in the South. Unfortunately, the trick worked and lulled the Southern senators (Hard to believe that they were actually Dems then) into voting Uncle T to serve as a justice of SCOTUS.

After extensive debate, the U.S. Senate narrowly confirmed Thomas by a vote of 52-48.[33]
In 1991, public opinion polls showed that a vast majority of those polled believed Thomas over Hill;[34] 47% of those polled believed Thomas, while 24% believed Hill.[citation needed]
After extensive debate, the Committee sent the nomination to the full Senate without a recommendation either way. Thomas was confirmed by the Senate with a 52 to 48 vote on October 15, 1991, the narrowest margin for approval in more than a century.[35] The final floor vote was not along strictly party lines: 41 Republicans and 11 Democrats (Dixon (D-IL), Exon (D-NE), DeConcini (D-AZ), Robb (D-VA), Hollings (D-SC), Fowler (D-GA), Nunn (D-GA), Breaux (D-LA), Johnston (D-LA), Boren (D-OK), and Shelby (D-AL) now (R-AL)) voted to confirm while 46 Democrats and 2 Republicans (Jeffords (R-VT) and Packwood[36] (R-OR)) voted to reject the nomination.

1) You are ignoring the fact that the ABA approved him. He actually got better marks from them than other nominees.
2) He was strongly opposed for being conservative....not actual questions about his abilities. Same goes for very lib justices. Don't make me laugh that these confirmations aren't just highly political fund raisers...you said it yourself that the senators will vote to protect themselves regardless of what they think qualifications are.
3) You are Soooooo close to an ephiphany....that there isn't much difference between democrats and republicans. Now just take a look at why healthcare reform hasn't passed. Could it be that people vote party and then don't hold those people accountable because they are on "my team"?

Most of these confirmations are just fundraisers anyway. Both sides do mass mailings claiming that this will help\hurt abortion...send money now! My wife is registed Dem (im not registered to a party) and she got a bunch of money requests that Roberts confirmation would end Roe v Wade....LMAO! Then the Dems that did the mailing confirmed him while pocketing millions. (Reps did the same thing and Roberts isn't going to change R vs W. Just taking the wool off the sheep.
