One other thing that might be considered: Enforcement

If I have a Bluetooth device - how will they know if I'm talking on the phone or singing to something on the radio or merely talking to myself.

Seems to me that this suggestion would be darn near almost IMPOSSIBLE for Police to enforce

How many more John Edwardses (personal injury attorneys) do you want to be operating out there, under no acceptable (to Right Wingers) legal authority, like Colonel Kurtz in the movie "Apocalypse Now"?

I think we could use more of them. Businesses need to be held responsible for the damage they cause.

I'm not worried about death. I'm worry about YOU causing my death because of something as trivial as a phone conversation. I'll die when I die; but it damn sure shouldn't be because your cell phone and the ear attached to it killed me.

Bit off topic, but I think it really boils down to many folks not placing any value at all on human life. Pretty sad.

You have nothing to fear there. I despise cell phones, and it will be a cold day in Hades before I choose to carry one. They are nothing more than an electronic leash that people willingly hitch about their necks.

But I feel no need to regulate the behavior of other individuals because I see a minority of drivers do something dumb. Heck, why not ban traffic lights because someone might run a red light and kill someone?

Life is unpredictable, and the only aspect of it that is 100% certain is that we all become worm chow. And something as draconian as this, which I believe also wanted to ban talking on a hands-free device, will neither stop nor delay the inevitable.
