Yes, we should expect Breyer to retire soon, IF Biden eventually wins. And Breyer has not (always?) been an "activist judge". It does astound me, as a non-lawyer, why "judicial activism" is supposedly some good thing.

It seems to me that ACB said it succinctly. It is Congress' job to legislate, and to do it right. 80% of them are lawyers, yes? It's not the SC job to rule on on "good" or "the right thing". It's only to rule on the Constitutional legality of any issue.

If Thomas is 1/2 as "partisan" as people believe, why wouldn't he wait and retire after a Republican becomes President?

Thomas retiring now would be a bad thing and I don't think he'll do it. I don't want more crap from the left and am happy with the young 3 Trump appointed.

$5 that if any Supreme Court member retires or passes Leader McConnell will decide the "new" precedent is they won't consider a nominee at all unless the President and Senate are held by the same party.

LOL! Biden could make vastly more money not being president (at least for the time he may be in office.) If he survives his term, he could do very well as an ex-president (look at Obama.)
