well, i dont see how the judge can force this person to pay for those lawyer bills. judges never forced cities to pay for gun makers lawyers bills after they were always thrown out for being a foolish lawsuit.
To make the analogy fit, the mascara brush producer would have to deliberately use a mascara brush design known to cause eye injuries, have a history of internal documents acknowledging there was a problem with the mascara brush design and a history of lawsuits from injured customers. Oh, you also have to have someone go on the stand and say "due to our customers' unique usage pattern, they like steel-tipped mascara brushes", only to be confronted with a subpoenaed internal memo documenting the exact opposite.
Incidentally, the first McDonald coffee lawsuit brought was for medical costs only - 20K or so. It was only when McDonald countered with an offer of a coupon for another cup of coffee (or something similarly insulting, the offer was so trifling nobody can remember it) that the full legal machinery was brought to bear.
There are really, seriously frivolous lawsuits, but that one is a bad example.

that wasn't a city that was ordered to pay. the plaintiffs ordered to pay were the dix family, handgun control, inc. and the san francisco law firm of hersh & hersh. i can't find any mention on if the fees have/haven't been payed.
again, can you cite any city being ordered to pay legal fees to a gun manufacturer?
