I guess you NEVER heard of the term Pro Forma. I think you need to contact Harry Reid, you know the dem Senate Majority Leader. HE is the one who came up with Senate procedure.
There's no need for Pro Forma obligation unless the Congress is in recess. W Bush may not have known that, Harry Reid did. He also knew that Bush didn't and took advantage of it.
That, Rick, is the best thing I have seen since Obama did his unconsitutional actions. It must have slipped past some editors at the WAPO although it is filled with truth.

President Obama is not the first to abuse the recess appointment power. Theodore Roosevelt did as well, but for almost 90 years the executive branch has generally agreed that a recess as recognized by the Senate of at least nine to 10 days is necessary before the president can fill any vacancies with a recess appointment.
Glenn Beck and I would be very glad to point at the two men mentioned in that paragraph, Teddy Roosevelt and Barack Obama because they are both very progressive in thinking.

Bush appointed William Pryor, Charles Pickering, John Bolton, Sam Fox, Susan Dudley, and Andrew G. Biggs....where are your screams about Bush acting in a unconstitutional manner? Not a peep then, and not a peep now.

Anyway, the title is incorrect: if the Senate was truly 'in recess', then the appointments were consitutional.
The title should be: Obama's non-recess appointments are uncontitutional.
But Obama declared the Senate to be in recess so he must have believed that they were in recess. I understand your problem here but after reading the link I was convinced that the WAPO title, which was the same, was right. Too much was pointed out about why it was unconstitutional activity on his part.

First of all, there is no need for pro forma sessions if the congress is NOT in recess. But more importantly, are you aware WHY pro forma obligation was put in place?

Roy, don't assume so because you've a limited supply of sources that you don't shy away from trumpeting... The Blaze for example. Why not just quote directly from the US Constitution and discuss it here? Or, is that simply not your style?
