Senate Democrats agreed Wednesday night to a Republican demand to block President Obama from making recess appointments while Congress is out of town campaigning for the midterm elections.
Democratic leaders have agreed to schedule pro-forma sessions of the Senate every week over the next six weeks, a move that will prevent Obama from making emergency appointments, according to Senate sources briefed on the talks.
Article II, Section 2, of the Constitution of the United States:
"The President shall have Power to fill up all Vacancies that may happen during the Recess of the Senate, by granting Commissions which shall expire at the End of their next Session."

Perhaps President Obama will declare that this is an 'extraordinary occasion' and hence 'convene both Houses, or either of them' (Article II, Section 3), so all members must return to D.C. and they will not be able to campaign for their miserable seats.

Some real bi-partisan action. Yeah, there is some go-along-to-get-along happening with the Dems, but it's hard not to wonder, seeing the impending bloodbath this November, if the Democrats aren't more than a little fed up with Obama.

I agree with you on a lot of things but, recess appointments are legal.
Any Preident using it is NOT doing an "end around trampling of Senate authority".
Even the democrats were upset with the latest recess appt - Berwick.
He didn't even give the Senate an opportunity to schedule a hearing, interviews, nothing.
They are legal, but the way obama has been going about them is contrary to his "pledge" regarding the role of congressional authority, contrary to his rhetoric, scolding Bush for his appointments.
They are legal, of course, and so is the Senate adopting the tools to prevent them.
