I live in East Mesa and have an HOA in my neighborhood (parkwood ranch) The CC&R's state that a boat cannot be parked on the street of within street view. I have a RV gate and parked my boat behind it. 5 days later I get a notice stating that I am in violation and need to move the boat to avoid being cited. The boat itself is not visible from the street, but the wakeboard tower extends well above the RV gate. Since it is a collapsible tower, I thought I would not have any more issues if I simply lowered it down after we park it. No dice, even with the tower down, I still got a letter in the mail stating to move the boat within 10 days, or pay a 50.00 fine. Here is a picture of the boat parked behind the gate with the tower folded down. I can't fathom why it is still an issue. The bottom half of the tower extends maybe 4 inches above the top of the gate. Are HOA's really that anal that they would make this an issue? Thoughts??? Any recourse, or am I doomed to either sell the boat or pay 100.00 per month to store it in some dusty, uncovered lot?

Are you sure the latest letter from them is after you lowered the wakeboard tower? I'd email them this pic and tell them "it's been taken care of".

I'm inclined to agree. But if it's your neighbor who is complaining, they will make you move it. I'm guessing that somewhere in the legalese of the CC&R's is a clause that says you can't keep boats or cars or storage sheds, etc. in the backyard or hidden behind the walls.

I would talk to the management company and like others said say it's taken care of. A visit to the next HOA meeting to show the board wouldn't hurt either (you may have to do it during the board only part of the meeting so that might be before or after the general meeting).

Tell them to sue, and leave it where it is.

Precisely why I didn't buy into an HOA.

If its only showing about 4 inches, I'd maybe dig down 6 inches and then park it. If you're lucky, you may get away with just holes for the wheels.

Default Boat

If the boat is sitting on a trailer could you deflate the tires to get you the four inches?
