I was living in a house, that I first rented from individual, then supposedly it was being foreclosed on and bank took over. I lived there for 2 1/2 years and decided to move. After I moved apparently the landlord filed for eviction. I moved in October, he filed eviction in December and got default judgement against me. He claims he did not know I moved and I am unable to locate the email I sent saying I had, however the utilities were disconnected and the house was empty when the eviction process began. This is causing a problem for me because it is a bad mark on my credit. When I was garnished for the judgement was the first I knew of the issue. I had to file bankruptcy to recover my money. However I don't want the judgement on my credit report and feel as though it was a wrongful eviction as I had already moved. I did not have a lease or any type of agreement. do I have any recourse in getting this removed?

Did you ever have a lease? How much notice did you (supposedly) give? Does the lease spell out how notice is to be given?

why would he file for eviction after only 2 months without first contacting you?

Okey Dokie I never had a lease with this person, supposedly the bank had taken over I never signed a new lease. He was given 30 days notice

kc chris his claim is that I still lived there but I didn't

Let your lawyer sort it out. If you filed bankruptcy because of it, this is another reason to talk to an attorney.

Tenants' rights attorneys will know how to navigate this. Legal Aid has some good ones, if you qualify.
