Yup, agreed. Too easy to appeal if they don't move the trial.

Although I tend to vote for conservative politicians, religious politicians of any party baffle me at times with their stupid laws and/or ideas.

In Idaho's case, we, the taxpayer, are going to pay to fight a law that was already decided upon in 2003 by SCOTUS (Lawrence v. Texas, 539 U.S. 558). I would have hoped the all intelligent one in Boise would have read up and understand, you "ain't" going any higher than SCOTUS so why fight something already ruled on?

As for the Daybell trial....yes that needs to be moved and the minute the press got full access to the court room video, it was pretty much decided that would happen. I believe pretrial publicity is the major reason for a change of venue request. And I don't think Twin Falls is far enough. If anything, I would head a bit further west to Boise.

But the judge may wait till after or possibly during the voir dire process to decide on a change. A lot can be learned about the jury during voir dire by a smart attorney and judge.

Very possibly true. The argument against, however, would be that this case is not only in the press and well known throughout Idaho, but also nationally. So there's no place that would be any less prejudiced than where it is already. Or so the argument would go.

The national notoriety is certainly true, but I think the Daybells want the trial moved because they were fairly controversial inside the Mormon community in Rexburg with their extreme religious beliefs.

The jury pool in Rexburg is almost guaranteed to be 100% LDS. And many of them could know either or both of them personally, though Chad is the best-known of the pair.

Idaho among worst for school funding - Spokesman.com - June 1, 2011

Idaho ranks 50th in the nation for per-pupil spending on schools, a measurement for which the state perennially has scored a low ranking.
Now, according to the latest U.S. census report released last week, Idaho’s ranking for per capita spending based on personal income in the state has dropped dramatically, from 15th in the nation in 2001 to 41st.
Spending is not equal to Quality.

Unfortunately, education quality here is all too often dependent on how much is spent on teachers' salaries.

It's very hard for some of our rural districts to attract good teachers due to low population and remoteness.

When a district's population is low, so is its tax base. If the population shrinks, or loses economic ground, passing a school bond can become supremely difficult.

So as often as not, when a local schoolteacher finally retires, there's no one to replace her. Most of the rural teachers are women who are locals. They become teachers after their kids are old enough to go to school.

Young teachers who are single don't want to teach in these districts, by and large, unless they grew up there and want to return home after graduation. Idaho is having a hard time getting young teachers everywhere now, due to the low wages and escalating costs of living.

Wyoming seems to be the place now where they go, as the wages there are much, much higher. Wyoming has a depletion tax that funds it's education system, and the state chose to raise all teacher's salaries as a way to attract more investment and to make the state more attractive as a place to relocate.

For education majors here in Idaho, that's a very good deal. They are still close to the Idaho home and family, but can make substantially more money teaching in better equipped schools, even in the most remote parts of the state.

Larger cities here have an easier time getting replacement young teachers, but quite often, the young women quit the profession when they marry, and if they rejoin the work force later, don't go back into education as their career.

So in the remote little towns, any teacher they can get will do. Not from any quality aspect to the person's abilities, but only from sheer necessity. Elementary school teachers are easier to find than secondary teachers.

Some districts here have combined their secondary schools as a way to elevate the quality of the education, but not all our districts can combine- the large counties with low population are simply too large to allow it.

Question is, will they follow that schedule, and if they don't what will we do?
