Local story - Homeowner gets to intruder and deals some justice before the police could haul him away - after which they cuffed the homeowner and now he's facing assault charges! Outrageous!!! He was doing what anyone who's home has been invaded and family threatened should have the absolute right to do!

washingtonpost.com

"Police say they had brought the burglary suspect, Irvin R. Lambert, 51, to the ground and were handcuffing him when Anderson kicked him in the face. They charged Anderson with assault and battery. Paramedics treated Lambert at the scene for facial injuries, police said. Anderson and Prince William police disagree on the details of the incident last Saturday, which raises the question: Was Anderson a vigilante who helped catch a dangerous burglar or a father seeking to protect his family?"

Under the circumstances, I would have done the same. If I catch someone inside, it's hunting season.

I agree with you: if I caught someone breaking into my home, it's open season. However, if the police have already brought the guy down and are in the process of handcuffing him, I don't think I'd kick him in the face (I'd have done that long before the police arrived!)

The guy was in the process of being arrested, the owner should have left it alone. Law enforcement had him, thats the end of it.

Now, I don't know if the intruder had hurt the owner, or what the exact details of the robbery were. I know that if someone breaks into my house, if I catch them, they are dead. No need for the police to arrest him. But once the cops have them, I leave it alone, job is done.

Tell ya what... If my daughter called - terrified - because there was an intruder in her house, either the intruder or I would be carried out of the house on a gurney. Probably a body-bag. Bastards.

When the police are working, they don't like to have amateurs butting in any more than an electrician wants a homeowner suddenly cutting wires that he is working on. The time for emotion was over once the police showed up. IMO, the guy was either an idiot or hopped up on adrenaline.

While I understand the guy wanting to kick the guy, doing so while the cops were cuffing him was pretty stupid. As others have said already, he should have done that before he was in custody. If he had beat the guy to a pile of goo with a T-ball bat , before the cops had him, no harm, no foul, and I'm sure the cops would not have worried that much about it. Now the cops have to answer for how the homeowner managed to do this while the creep was in their custody. That changes things a mite. The guy was a varmint, no doubt, and surely deserved a kick in the face, but the opportunity was past when he went into custody. The homeowner will probably get off with a slap on the wrist, and a stern warning to learn some better self control.

Any body ever heard of "Anger Management"? Try it. Might keep you out of jail someday.

How would you like it if the judge said he would reduce the guy's sentence, because a substantial part of his punishment had already been carried out by the psychotic, violence-prone out-of-control homeowner.

"I sentence you to six months in jail or a kick in the face. Sentence already served. You're free to go". How about you. If you were the defendant, and given that choice, would you choose the jail time or the kick in the face?

The police had the guy down and were putting handcuffs on him.

Assault is assault, and stupid is stupid.

The homeowner had his chance before the police got there. He was wrong, he should have just waited until the guy got out of jail for another chance.

I thnik that the guy will proably have a feeling of satisfaction in the end;and should ask for a jury trial for sure. A gun and a fast car could have aviod the fight althogether.Cool anger is always better and more more effective on these thugs.Any father who managed his anger in that situation is a whimp ;pure and simple.
