Any body ever heard of "Anger Management"? Try it. Might keep you out of jail someday.
How would you like it if the judge said he would reduce the guy's sentence, because a substantial part of his punishment had already been carried out by the psychotic, violence-prone out-of-control homeowner.
"I sentence you to six months in jail or a kick in the face. Sentence already served. You're free to go". How about you. If you were the defendant, and given that choice, would you choose the jail time or the kick in the face?
How about "six months in jail or ten minutes alone with the person whose home you broke into and whose family you threatened"? Might that be a 'fair' sentence?
The police should simply have turned their backs. I agree that the homeowner will get at most a stern talking to. After all, this *is* Virginia! I doubt any charges will be brought.
You call him "psychotic, violence-prone and out-of-control". I take it your sympathy falls with the poor, misguided perp who probably was under the control of drugs, having a bipolar moment, or just felt discriminated against by an evil society? (No doubt angry at not having adequate health care, right?)

Nurse won't be around for another hour or so. And even then it's bath time. Then they do lunch at 11:30, followed by nap time, then Aquarobics at 3:00.
Bottom line is that the guy was pumped up on adrenaline, and probably madder than a hornet.
He should not have kicked the burglar in the face while he was down on the ground.
It is, however, unfortunate that he didn't get to him while he was still in his daughter's house.
But, I take it, we can agree that this man wasn't protecting his family when he hit the burglar in the face?
