They acknowledged that some of the information in the boxes is not in the same order as are the scanned documents that were presented to Mr. Trump’s lawyers. They clearly stated that all of the information found in the original boxes is still present and in the same boxes in which they were found. They absolutely did not acknowledge the that key evidence was “tampered with”. You can decide for yourself if this reordering is material, but the headline of the article you shared is completely misleading. I think it takes a bit of imagination to believe this is a significant matter.

Why did Smith knowingly lie to the court about it?

Quote:
Because these inventories and scans were created close in time to the seizure of the documents, they are the best evidence available of the order the documents were in when seized. That said, there are some boxes where the order of items within that box is not the same as in the associated scans.3

The Government acknowledges that this is inconsistent with what Government counsel previously understood and represented to the Court. See, e.g., 4/12/24 Hearing Tr. at 65 (Government responding to the Court’s question of whether the boxes were “in their original, intact form as seized” by stating “[t]hey are, with one exception; and that is that the classified documents have been removed and placeholders have been put in the documents”).

It is not up to us to decide if the "reordering" is material. Smith is the one who is trying to make the case that Trump had accessed the boxes and knew that they contained classified material. It would appear that it would be hard prove now that the evidence had been altered, whether by shipping, or by intent, or by general incompetence on Smith's part ...and Smith's hands appear to be unclean since he'd previously knowingly lied about the matter.

Quote:
“For prosecutors who are trying to prove that the defendants knowingly possessed these documents to then destroy the evidence that would undermine that claim is a very serious violation,” he added.

It takes TDS-fueled imagination to believe that Trump is guilty of each of the __ (fill in the number) crimes he is being accused of.

If you changed the mechanism of the gun and told the court that you didn't.

This is just another Trump smoke screen to try and confuse and delay every aspect of his activities.
Smith lied to the court about the situation. There are other issues with this case.

And this judge is just looking to deep-six this case. This is just more fuel for the fire.

The audio that Cohen had taken of him and Trump allegedly discussing plans to pay hush money is now suspect and even Daus, tech expert and apparently works for the DA and who had investigated Cohen's recording, admits that everyone will just have to take serial liar Cohen's word for it that it is legitimate. LOL.

Trump's lawyer Bove: So we just have to take Michael Cohen's word for it?

Daus: We do.

Sheesh, the recently unredacted documents showing dirty dealings by the left, Smith lying to the court about the altered evidence in the boxes, the prosecution using liars as their star witnesses, evidence that now seems to rely on "the word" of one of the serial lying star witnesses for legitimacy, ETC., ...why is this case still going on? Biden*/Garland must have a lot of dirt on Merchan, and are using it against him.

I believe he's guilty of a lot more than he's been charged with.

If he is as innocent as you believe (and as he claims), then you and his supporters have nothing to worry about. Multiple Grand Juries of citizens of the United States have found the evidence presented against him is sufficient to make multiple criminal charges in multiple cases. It's not like a single Prosecutor, President, Attorney General applied these charges independently. Mr. Trump has adequate resources to secure experienced and knowledgeable lawyers, investigators, jury consultants, and he has the presumption of innocence. I'm more than comfortable letting the matter play out in Court. I think your concerns reflect that a jury is likely going to see what the truth is.

Not only will this mean Trump might actually be held accountable, but more importantly, it will make his supporters look foolish for all of the blind loyalty they have given him. Folks have invested so much in him, admitting they were wrong is impossible---easier to say he is a victim, being persecuted unfairly, rather than see and acknowledge what is true. Sort of Stockholm Syndrome kind of thing I suppose.

While I am sure you believe that, the reality is, this is not the case. Mr. Smith (or his team) acknowledged the shortcoming, and they made their case that the misfiling of documents was not material to proceeding forward with the trial against Mr Trump. We shall see what the Judge says.

The reality is, he'd lied to the court. You can try to pretend otherwise, but facts are facts and you cannot change them just because you wish to.

The Smith appointment as a special counsel is illegitimate since it was not created or confirmed by congress. The Meese brief asserts that the office Smith holds has not been created by Congress and violates the “Appointments Clause” of the Constitution.
