sounds great in theory, but society in general isn't accountable for the result in the vast majority of cases. If you walk down an icy sidewalk wearing flat soled loafers, and you slip and bust open your head, you don't slap a bandaid on it and go buy some snow boots, you hire a lawyer and sue whoever owns the sidewalk for not making it retard proof...
and you usually win...
the result is that it now has to be illegal to be a retard, so that when texty boy gets flattened by a cadillac, it's a lot harder to sue the old guy driving it.
...or we (as juries) could just start telling them "No" and not hand out cash prizes for stupidity.
