I worked for home helpers as a caregiver on my way to meet a client i had a blown tire my employer insisted i leave my on the side of the road and get a taxi let me mention that i was only going for an hour to find out i was suppose to do my original shift wasn't till 6pm when i told my employer i would not leave my car due to the fact it could be towed or i could get a ticket she told me i was making excuses told me never mind don't ever come in. The next day on the 12th. she started texting me telling me if i don't want to work for her company to quit i told her i was still interested during our texting she seemed like she didn't want me working for her and my employer is known for not firing anyone just never calling them again so they can't collect unemployment i asked her two times if i was working for her or not but she never wrote me back finally later on during the day she sent a text saying i was being terminated for misconduct attitude toward employer, she stated from saying you (think a job makes no money is a good opportunity for me. Wow) was me giving her attitude the unemployment office still found me eligible they this did not fall under misconduct. after she terminated me she told me to never contact her again i didn't go for unemployment right away i wanted to find a job after more than two months i applied for unemployment and I was approved my employer appealed when I had my phone interview the lady told me my boss said i was vulgar and profane with her using the word stupid i told the interview lady that's not I've never been vulgar or profane with her. Well i finally received my appeal notice she's saying because i asked her twice about if I'm working for her still that i was wanting be terminated so i could receive unemployment which is completely untrue i didn't apply till almost 3 months after being fired. Can give me advice? It's she aloud to keep changing her story for firing me? What could be my chances of winning? I've never had a write up and no warning

This case is yours for the winning. I am so sick of reading stories of low brow, trashy employers trying to keep people from getting UI -- it makes me angry. Fight this and remember the burden of proof is not on you ! You've got this won as long as you stick to your story, and do not say anything incriminating. This woman sounds like a piece of work and I hope she has to pay you just for being a nuisance to the UI System
I don't really have any evidence but my word i requested my employee file so it can be brought I've had no warnings nor write ups i have two witnesses that were with me during our conversations my brother and bf so they wrote a statement about what they heard me saying to prove i wasn't vulgar or profane towards her but that's all I have.
Perfect, anything you have is good -- but you may not need present ANYTHING. Wait for the employer to reply -- you are entitled to see what she has as evidence. She probably has nothing, which will likely be an auto win for you.
