I work a 40 hour work week. Last week, my job starting cutting everyones hours. We are paid biweekly. So, now I will be 16 hours short every pay check. Can I apply for unemployment for those 16 hours? I live in the state of New York. I am a mother of 3 who desperatly needs all my hours at work, so I'm kind of freaking out.

Probably not. NY has a terrible partial benefit formula. If you're still working 4 days per week regardless of regardless of hours, NY does not consider you unemployed.

Most likely not as Chyvan said. Even in a pro-unemployment state like CA you would not get anything.

If we assumed the OP worked 40 hours a week and made $20 an hour his/her benefit amount would be $400 per week. In 4 days the OP would make excess earnings(over 125%) of their benefit amount.


Chyvan....Are there states that don't look at earnings during the week and simply look at days not worked as unemployed? And then pay a partial compensation for that 1 day?

There might be.

The thing with NY is that they don't care how little you earn. Even if you worked 1 hr/day for 4 days, you get nothing even if you have a max benefit of $405/wk and the 1 hr worked was for minimum wage. 4 hrs (over 4 days) x minimum wage is a lot less than $405/wk. NY's formula is work 1 day lose 25%, work 2 days lose 50%, work 3 days lose 75% then on top of that if the earnings in those days exceed your weekly benefit amount, you still get nothing.

Whereas just about any other state would pay you something.
