There was a mix up on my part about dates available to work with EDD. I was out of town for a 7 days and the days feel between two weeks. I felt that since I was out of town and was not able to work, I would check the box saying that I was unable to work for those days. Not thinking things through, I only checked the box for one of the weeks. My thought process was that it would be ok since I was unable to work for a total of only 7 days. I had a phone interview shortly after and I told her the exact dates that I was gone. Checking only one box was NOT ok with her. She told me that I needed to repay the other weeks worth of benefits and with her clarification, I agreed.

I recently received a letter in the mail saying that I would be penalized. It's not what I expected but I understand. I am paying it back now. Luckily, I will return to work again in the next two weeks so I will cancel my unemployment now. I have already paid back the benefit amount + penalty fee.

My questions are: Since EDD is considering this FRAUD, do I have any legal problems as a result of this? Will it show up on my record? I have been working part time. Will they notify this employer? Would this employer likely fire me?

No. This was a very small oversight.

No, it will not show up on any 'record' such as a criminal background or credit check.

Possibly for something else, but not because of your EDD oversight/misunderstanding.
