I am going to be laid off in 4 weeks ( Last day is 10/31) i am currently working part time and collecting partail Unempoloyment ( claim will end 11/2/2010) must i file a new claim, or can i use a extentsion on my old claim?

Since your benefit year will end 11/2, NJ is required to evaluate your last year's earnings to determine whether you qualify for a new claim. If you do and your new benefit is not reduced more than $100 or 25%, then you will be required to collect on the new claim. When that is exhausted, assuming EUC is still in effect, you would revert to whatever EUC benefits remain on your first claim.

If, however, your new benefit is reduced $100 or 25%, then under HR4213, you have the option to continue on the old claim.

Lastly, if your earnings last year do not qualify you for a new claim, your old claim would be reopened and you will collect whatever benefits remain under that claim, including EUC.

But, NJ has to go through the process and you need to call them to recertify in order to begin that process.
