Okay I'm moving into a new apartment in about a week. Signed and returned a new lease the first of March. They showed me an apartment the day before i returned my lease, but told me I won't be getting that particual one because someone else turned in their lease and they are getting that one. But they have another one coming up when by the end of the month. We agreed, now the landlord is wanting on getting the keys from the old tenants and i still haven't even seen the new apartment. I am wondering what will happen if they don't get the keys by move in date? I put down a $300.00 deposit and assume I will get that back and a voided lease.

Any advice?

The old bait and switch. I have a feeling you won't be as happy with your new apartment as the one you actually saw. Your best bet is to ask for your deposit back, and obviously you have a right to do that since you're not getting the one you signed up for.

I'm not sure if I read your post right, but it sounds like they accepted two deposits for one apartment, and are now trying to get you to sign a lease to one you haven't even seen. If that's what happened, this property manager sounds really sketchy. RUN.

In the few times I have rented I never saw the actual apartment I would be renting. Seems normal to me.

I don't think the issue is that they aren't getting the exact unit they saw. In large compleses, they often show whatever similar unit is vacant at that time, then you get the one that is available at your move it. The issue is that there may not be any apartment available. My advice is wait a few days and see what happens. The previous tenant could be taking a couple days longer to move.

This does sound like good advice but let me tell you about the old tenants from the landlords own words.

They were suppose to be moved out by the 5th of this month. They had some issuses, so the landlord agreed to let them stay until the 15th, and told us she would have the keys on that day. That was 5 days ago, and normally it wouldn't be such a big deal, but I do have to measure some walls to make sure some of my stuff fits, otherwise i'm paying movers to move large stuff they don't have to, and cost me more $$.

And no, just one security deposit on the original apartment. Just seems shady that we see one, turn in the lease the next day and the one I saw is rented out now.

Yikes! I worry that the LL won't have the old tenants out and you will have no place to move to. Better get on top of that now.

that's what I'm trying to do, my current landlord would probably let me stay another month to get this straighten out, but I really really really want to move out to get away from my ex-gf...
