No real surprise here - a couple of weeks ago the 10th upheld a similar decision out of Utah.

Quote:
A federal appeals court on Friday ruled Oklahoma must allow gay couples to wed, marking the second time it has found the U.S. Constitution protects same-sex marriage.

The decision from a three-judge panel in Denver upholds rulings that struck down Oklahoma's gay marriage ban.

The 2-1 ruling comes after the same panel ruled June 25 that Utah's ban on same-sex marriage violates the Constitution. It was the first time an appellate court determined last year's U.S. Supreme Court decision striking down the Defense of Marriage Act means states cannot deny gays the ability to wed.

The decision has been stayed pending appeals.

Good news Oklahoma and Florida for all loving couples given the fundamental right to marry their partner and raise a family if they chose to do so.

Its only legal in one county so far. And I can see them staying the ruling like all those other states.

Now the 3 gay couples in Oklahoma can get married

Yes, a step in the right direction. But you couldn't pay me to live there. I think Colorado is pretty close to legalization today. If the AG would just give up.

Same-sex marriage will likely become legal in Wyoming by Monday, October 20th.

Quote:
U.S. District Judge Scott Skavdahl plans to issue an order by Monday in a case that could legalize same-sex marriage in Wyoming.

The Tenth Circuit has held that same-sex marriage bans violate the Equal Protection Clause of Amendment XIV of the United States Constitution. When the United States Supreme Court declined to review that ruling, the Tenth's decision became binding precedent throughout the Tenth Circuit. Since Wyoming is under the jurisdiction of the Tenth Circuit, the judge in this case has essentially nothing to do but apply the law.

It appears as though Wyoming will be state # 31 (yesterday, Idaho became state #30) - though there's a chance Arizona will beat them to the punch, with a hearing before a federal judge scheduled there today.

Breaking news, Arizona's same sex marriage ban unconstitutional. And 11 am/ 12 noon Pacific time, Alaska will too have marriage equality if the Supreme court declines a stay. When I think of all the money that went to fight same sex marriage that could have gone to a worthy cause, such as helping all the unwanted children in foster homes and adoption facilities.

Arizona just fell. The state dropped its appeals and ordered clerks to start issuing licenses. Maricopa county (Phoenix area) is already up and issuing.
