The couple wanted to not include Monsanto's statement while the local the station wanted to do what is considered standard practice of allowing the opposing point of view even if their statement is false. That way those being attacked can at least give their own statement. Their report did run on the station with a revision of allowing Monsanto to give a statement on the subject. The lawsuit wasn't that FOX News wanted to lie. It was that the managers of a local station wanted to allow a corporation a chance to defend their product even if what they said was a lie.
The attorneys for Fox, owned by media baron Rupert Murdoch, argued the First Amendment gives broadcasters the right to lie or deliberately distort news reports on the public airwaves.
Defamation law holds public figures to a different standard, making it much more difficult for them to sue. But I suppose Obama could sue Fox if he really wanted to come down to that level.
And people aren't defamed in the Enquirer? And Fox News doesn't defame Obama on a daily basis?
