I would say if the same standard that applies to men and rape is applied to women then yes.
If not however I would say that this is ridiculous.
A man can be seduced but not raped.
As laws now stand a woman can be seduced but can later claim rape because she regrets it.

America.
outcomes of laws in Camb are generally determined by who you know and how much money you have. (so IOW, no real rule of law)

no real reason for a man to wake up, maybe right at the end perhaps.
for sure, as a fantasy this sounds great, but could be a nightmare situation in the real world.
for instance, an ex could try to get back at you by using her old spare key, getting into your bed, perhaps tie you up and then commit the act.
she could even then say that you raped her, as she didn't give you her consent (because you were asleep) - how about that idea?

yes, and I"m sure a tricky enough lawyer could spin this one out in court.

I don't think most men would consider that rape unless the woman was a pretty dang homely old hag.

Rape is rape it shouldn't matter what gender or how they look. Having sex without the other persons consent is rape.

that's right, and a late night succubus, of epic erotic fantasy, is unlikely.
unless in a dream of course........
