Not any more, it doesn't. In nine western states, at least.

Until the next appeal.

As always, they will get the government they deserve.
Written in 2011, but still true---

"The Supreme Court has been in scold mode, and its target has been the U.S. Court of Appeals for the 9th Circuit. In five straight cases, the court has rejected the work of the San Francisco-based court without a single affirmative vote from a justice. As the most liberal circuit in the land, its work quite often is at odds with an increasingly conservative Supreme Court."

So the Supreme Court can legalize gay marriage throughout the entire United States,
And if they vote against it?

It will be an event that is remembered as a ruling that embarassed the court and the entire country. It will be seen as a modern day version of the Dred Scott decision.

SCOTUS will overturn it. Just about any decision coming out of the 9th Circuit is meaningless.

What's striking is that even SCOTUS's liberal judges routinely vote to overturn the 9th Circuit's decisions. The court is stuffed with Carter and Clinton appointees.

This. I sincerely doubt that it will be overturned, as our supreme court does have common sense, and anyone who has common sense realizes that Prop. 8 was unconstitutional and it's fundamentally stupid to ban gay marriage.

And what will it change really? Just because it allows people to marry doesn't mean it forces society to give it a thumbs up. You cannot make a law or repeal a law in an attempt to make people "like you" or accept you. They may tolerate you but that is all.

Personally, I'd like to see all the provisions attached to marriage removed. Taxes have nothing to do with marriage.

From the Capitol Resource Institute:

Family Group Vows: We will Defend Marriage and Proposition 8

Sacramento, CA--The 9th U.S. Circuit Court of Appeals ruled today that Proposition

8, the 2008 ballot initiative that codified the traditional definition of marriage,
is invalid and unconstitutional.

"This is a stunning assault on democracy and California's initiative process," explained

Karen England, Executive Director of pro-family group Capitol Resource Institute
and a key leader in the passage of Proposition 8. "Well over 50% of California
voters approved Proposition 8; today their will was overturned by a panel of arrogant
judges who want to impose their political agenda on the rest of us."

The 9th U.S. Circuit Court of Appeals' ruling is not the end of the road for Proposition

8.

"The truth will always prevail and we are confident that the traditional-and true-definition

of marriage will be upheld by the Supreme Court," stated England. "The voice of
the people must be heard and respected. The future of California and American families
depends upon the sanctity of traditional marriage. It's time for the courts to recognize
marriages' critical role in society and protect it."
