A gay man was excused from jury duty in New York last week because he said that discrimination against gays makes him a second-class citizen and therefore he couldn’t be impartial.

Jonathan D. Lovitz, an actor, model, and singer who will be on Logo’s upcoming show Setup Squad, wrote on his Facebook page, “I raised my hand and said, ‘Since I can’t get married or adopt a child in the state of New York, I can’t possibly be an impartial judge of a citizen when I am considered a second class citizen in the eyes of the justice system.’”

that is his choice. I for one love to sit on juries and nullify them if it calls for it.

I have been called 4 times and served twice (both were guilty). It is your duty as an American to serve.

He didn't get out of jury duty because he was gay. He got out of jury duty because he said he would not be impartial.

People who are opposed to the death penalty are not asked to appear for jury selection in capital cases. It has nothing to do with their race, religion, sexual preference, social status, educational level, etc. If they cannot put aside their personal feelings and go strictly by the law, then they should not serve on a jury.

Oh man! I wish I knew I could use the gay card to get out of jury duty. Had to serve for three weeks in '09, totally swamped me with work.

Yep;anyone can do the same by saying whatever makes them prejudice has he did.Happens all the time when asked to get out of jury duty.

I have been called 5 times since 1992, all 5 times were federal cases.

I voted guilty 1 time and hung the jury the other 4 times because of the awb94.
