The administration has the power to grant or deny waivers, with no objective standards or due process or rights of appeal. So favored parties and "special" interests including hundreds of union plans, do NOT have to obey the law! Look at the number of unions who are getting waivers, and then keep in mind that the unions only make up about 7% of the private sector work force.
