We have recently had it out with our builder. He is supposed to get the C/O today or tomorrow and we are set to close on Friday. Once he gets the C/O can he postpone the closing?

I'm sure he can postpone it but why? Dragging his feet is just a contractor trait : ) Did he say he wants to postpone?

Sure they could unless your sales contract has an amendment for that. The CO covers building and safety issues not cosmetic, so the house might not be 100% complete but he could have the CO. It's best not to fight with them at this stage or your punch list may never get complete.....sad but true.

He can do whatever he wants, but I doubt very highly that he'll want to postpone the closing once he has the CO- the last thing he wants to do is keep the construction loan open and keep paying interest. In most cases, it's the builder who's pushing the buyers to close on an incomplete home- not the other way around.
