Your fiance would have to apply for the mortgage in just her name in order to get the tax credit.

My accountant seems to think we can just try and get it and see what happens. Suppossedly theyre so backed up with the thousands of people that filed for it even though its their 5th home that they wont catch it.

Ok, you can try, no harm in trying....
But you should be ready for the aftermaths too.... maybe you will not get the credit if the Govt does catch it.... or maybe they give it to you and realize it was fraud and then try to prosecute you....
So do what you want to, but be prepared for the results.

I saw an article about how they have become a little cautious in evaluating the first time buyer credit applications after what happened this year with modified returns.

With all due respect to your accountant, I wouldn't try it. This is the mortgage broker's forte`, not the accountant's. Your mortgage broker will not likely file the application knowing it won't go through.

The OP was not talking about the application, but filing for the tax credit, which would be handled by the filer/accountant.

Unless the OP wants to risk being accused of fraud, I wouldn't suggest it - might even look around for another accountant... JMHO

I know the OP was talking about filing his/their tax return, I hadn't cracked open the bottle of wine that early in the day!!!

I agree, Elke, this accountant should not be cutting corners. Scary.
