We are renting a house in Nassau County that is a one family and the landlord has the basement rented out separately, however all the utility bills are in our name. Can the landlord make us pay for his basement apartment tenant without the landlord himself occupying the house or without the basement tenant paying a portion of the utilities? Thank you for any information you can provide.

If it's a one family house, and you're the family, then the apartment in the basement is illegal since only one family can live in the house.

You are not responsible for other people's bills. Make that clear to the LL, and tell him that you're not paying for someone else's utilities.

If he gives you a hard time, tell him you know the basement apartment is illegal and use that for leverage.

If he's that lousy a landlord, move quickly. There will only be more trouble ahead.

Short answer, NO. Even if the LL lived down there, you aren't to pay his utilities.

He can do anything he wants...renters are tax freeloaders and landlords can abuse them

when you decided to rent the house, were you aware of the tenant in the basement and that you would be paying the utility bills?

If you knew, then you shouldn't have rented the house.

If you were unaware of the tenant, then speak with the landlord about this being unfair to you and ask to have something like $100 / $150 per month taken off the rent.

If the landlord gives you are hard time, well I'm sure the other posters can advise something more to do about it.

Just cause the tax bill is in the owners name, doesnt mean that the tennant isn't paying it. Do you honestly think that a landlords $7,000 tax bill isn't in the rent?

Absolutely Buckthedog! Especially with all the illegal apartments landlords are renting, there's no doubt they cover the mortgage, taxes, and extra. Gpsma seems to have a gripe. Right though about landlords being abusive... although that's not what the post is about.
How though do we deal with the utilities where landlord won't cooperate? He says he pays for the water bill so that "evens it out"! That still doesn't mean we should pay someone else's utilities, who is not our relative, who has zero incentive to conserve energy, and who is not benefiting us but instead the landlord. Of course we can't shut off the utilities, but shouldn't the landlord have them in his name and then bill both tenants for a percentage? And is it possible at all to recoup some of the money we already have paid for the utilities for the basement apartment?

1. You can go on www.mynassauproperty.com and check if the apartment is legal.

2. If not, you can talk to the landlord again and if he continues to be uncooperative and you think it'll help, you can threaten to report him.

Have you considered moving?

Should you pay for another tenant? No way, no how!!!

If it is an illegal apartment then the property is not assessed correctly. This would mean it is not being taxed at a rate that would coincide the the burden on services it represents to the towns. A single family home rented to a single family is a wash when taxes are concerned.

There is no way you should be paying utilities for them. Water bills are amount to peanuts when compared to electric/cable and gas.
